Andrey Artyushenko is a lawyer, arbitrator, certified FIDIC trainer, witness expert in construction, EPC and FIDIC expert in Kazakhstan and nearby countries in the region. He has more than 25 years of Legal experience in contract law, real estate construction (FIDIC contracts, EPC, EPCM construction, PPP), corporate issues, M&A, litigation, arbitration, etc.
Andrey has been worked on the different project across the region: Hydro power plant construction in Tajikistan; Gas power plants, ore mining plants, oil and gas pipelines, infrastructure, ski resorts, hotels, and other in Kazakhstan; infrastructure in Uzbekistan and others.
As an arbitrator has been involved in different cases related to supply, goods quality and construction in the region. As a witness expert Andrey has provided a legal opinion for arbitration in Stockholm, ICC Paris, LCIA and SIAC.
Andrey has experience representing clients as a counsel or co-counsel in ICC, SIAC, Abu-Dhabi ADCCAC (now arbitrateAD), Atameken (Kazakhstan), Kazakhstan International Arbitration and others.
Andrey is registered in the Kazakhstan Bar Association, acting as an expert in Almaty city administration, participates in FIDIC subcontracts development as a part of Tas group #9.
Recent projects in which Andrey has been involved are:
Co-counselling jointly with two international law firms (Integrites, Freshfields) the local Employer against an arbitration claim under EPC construction contract (ICC, Paris) of the China contractor on the Kazakhstani based Refinery project. Claims was related to the quality of the constructed assets, guarantee period, etc.
The reconstruction of the Almaty thermal power plant 2 by an international contractor (China), Republic of Kazakhstan, worth about 750 million US dollars (EPC contract). FIDIC based contract development and negotiations with the contractor.
The greenfield construction of a 1000-megawatt steam-gas power plant in Kazakhstan, has a project cost exceeding 1.3 billion US dollars (FIDIC 2017 Silver Book). FIDIC based contract development.
Construction of a gas processing plant at one of the fields in the Western Kazakhstan Region with an estimated cost of around 1 billion US dollars. FIDIC based contract re-development, risk allocation and legal support.
Construction of an integrated gas chemical complex in the Republic of Kazakhstan with an estimated cost of several billion US dollars, Kazakhstan Petrochemical Industries Inc. Preparation for arbitration against China contractor.
