Hasit B. Seth is an independent counsel, arbitrator, and mediator with over 25 years of experience in technology disputes, including disputes in construction. He is admitted to practice in New York and India. He is empanelled with multiple leading international arbitral institutions (HKIAC, SIAC, DIAC, VIAC, AIAC, THAC, KIAC, among others) across Asia, Europe, the Middle East, and Africa. His practice spans both common law and international arbitration frameworks, combining advocacy, tribunal work, and dispute resolution design in technically intensive infrastructure and construction matters. Mr. Seth’s degrees are: B.Sc., LL.B., LL.M. (Mumbai University, Gold Medal), and an LL.M. (FPLC, USA). He holds two U.S. patents as a sole inventor: US 9,160,681 and US 8,949,654.


Mr. Seth has served as a sole arbitrator, presiding arbitrator, and chair in domestic and international arbitrations, including institutional and ad hoc proceedings. His construction arbitration experience includes disputes arising from railway tunnelling projects, data-centre construction, housing and real estate developments, PPP-DBFOT road construction projects, and major urban infrastructure works, including monorail construction. These disputes have involved claims for extensions of time, variation valuation, delay and disruption, liquidated damages, termination, and complex quantum assessments in multimillion dollar disputes. He has delivered multiple reasoned awards within compressed timelines, reflecting strong case management and procedural efficiency. In addition to tribunal roles, Mr. Seth has acted as first-chair counsel in high-value disputes in courts and arbitrations.


Mr. Seth is regularly appointed by courts and institutions to mediate disputes. His mediation practice is informed by formal training at Harvard Law School and accreditation with leading mediation centres, including court-annexed and international centres.


His professional engagement with construction law extends beyond practice into teaching, scholarship, and institutional development. He has delivered specialised lectures and training programmes on international construction arbitration, construction claims, dispute avoidance, and FIDIC-based contracting for engineers, lawyers, and arbitrators. He is actively involved with the Society of Construction Law, India and has contributed several articles to legal journals. His published work includes critical analysis of liquidated damages in the Indian construction industry and procedural best practices in complex arbitrations. He has undertaken FIDIC and other training courses.


Mr. Seth’s multidisciplinary background combining law, technology, engineering fundamentals, and finance enables him to engage effectively with expert evidence, technical documentation, and project records that are central to construction disputes. This integrated skill set, coupled with extensive arbitral exposure, positions him as a credible neutral and advocate in international construction arbitration involving sophisticated construction, contractual, technical, and evidentiary issues.
